- Contractors that fail to communicate observed conditions risk liability as well as risk inability to get paid for extra work arising from such conditions that should have been observed and communicated
- Identify differing site conditions
- Have these conditions called out and excluded from a contractor's work
- Or include the conditions in the contract for more pay as a change order
- Notification to the owner of existing conditions is essential for the contractor
