- Retrofit work often involves conditions of poor previous construction and other circumstances for which the contractor does not want to be responsible.
- Make it clear that the owner is responsible to pay for work due to unforeseen circumstances where:
- It increases the scope of work
- The owner request the additional work be done
- It is necessitated by hidden preexisting conditions
