This regulatory briefing is designed for professionals responsible for compliance with environmental health and safety (EH&S) requirements imposed at the federal and state levels. Panels will address federal and state laws and regulations adopted in 1997 and early 1998. The panels will also discuss federal and state legislative and regulatory priorities underway during the remainder of 1998, and likely through the year 2000.
Briefings will be presented by panels of experts who will cover specific topics. Each panel will provide summaries of newly adopted laws and regulations, major items pending on regulators' agendas, and question and answer opportunities for workshop attendees. Panels will present details in the following sequence throughout the day:

Briefing K: Strategy For Achieving Regulatory Site Closure: Issues Of MTBE, RBCA, Containment Zones And More

There has been an increase in California environmental agencies’ receptiveness to the consideration of contaminated site closures through the use of RBCA risk assessments, demonstration of passive bioremediation, containment zone petitions and brownfields redevelopment. The San Francisco Bay Regional Water Quality Control Board (RWQCB) has been in the forefront of the regulatory initiatives recognizing different pathways to closure beyond MCLs. However, some new concerns, such as the toxicity of MTBE can delay or add cost to achieving closure at UST sites.
A panel of regulatory and technical experts will present new approaches and techniques, both technical and strategic, for achieving site closure on sites contaminated by solvents, hydrocarbons, and metals. Presenters are drawn from the Board, environmental consultants, and lenders/developers.
New RWQCB initiatives will be presented with discussion of various regulatory pathways to acceptable site closures. The regulator’s recent partnering with developers to improve property, legal covenants, and comfort letters will be covered.
This one-day briefing will enable the participants to understand the regulatory requirements, determine when and when not to perform remedial action work, and design their own strategy for achieving site closure or the Board’s containment zone (CZ) status. Participants will receive a broad understanding of the latest cleanup level requirements, use of RBCA risk assessments, remediation technology applications, and closure/CZ data needs and criteria. Focus will be on the Bay Area regulatory environment and how to determine where your site is in the regulatory status matrix, how to plan on collecting the necessary data to meet closure or CZ criteria, and what steps to take to help accelerate the process.
Participants will receive relevant handout materials, including a site closure evaluation criteria and current applicable regulations.

BRIEFING L: DTSC Update for the CUPA Program

Wednesday, April 1, 9:00 a.m.– 4:00 p.m.

To assist local government agencies in meeting their mandates under CUPA (Certified Unified Program Agency pursuant to SB 1082 of 1993, H&SC Chap. 6.11), the State’s Department of Toxic Substances Control has assembled a team of experts to update agency personnel on a number of important issues. These include the following new and/or complicated regulations:
·Hazardous Waste Classification – Federal and State EPA personnel will provide an overview of the rules, regulations and procedures that determine how to classify hazardous wastes in California.
·Use of Hazardous Waste Constituting Disposal – The statutory requirements for recyclable materials used in a manner constituting disposal will be explained, as well as recently adopted regulations applicable to such materials. The distinctions between Federal and State laws covering materials used in a manner constituting disposal are explained. Practical examples will be provided.
·Hazardous Waste Recycling - The provisions of California’s hazardous waste recycling laws, including the conditions for operating under a claim to be an exclusion or exemption, will be explained for both RCRA and non-RCRA wastes. Practical examples will be reviewed.
·Financial Assurance for Closure of Hazardous Waste Facilities – The financial assurance (FA) requirements for closure of RCRA treatment, storage and disposal facilities, as well as non-RCRA facilities treating hazardous waste in California will be covered. The focus will be on the evaluation of financial mechanisms used for compliance with the FA requirements. An overview of the course materials and a self-directed workbook will be provided for participants to study and complete during the session.
·Pollution Prevention for CUPA’s – An overview of pollution prevention programs and strategies for CUPA’s including updates to California’s hazardous waste source reduction planning law (AB 1089); and results of DTSC/OPPTD’s source reduction plan evaluations (industry specific reports).
